Your privacy is important to Advanced Opto-Mechanical Systems and Technologies Inc. ( “Brickeye“, “we“, “us” or “our“).

This privacy policy (the “Privacy Policy” or this “Policy“) outlines how we collect, use, disclose, manage and safeguard your Personal Information (as defined below) on our mobile application services (the “Mobile Services“). All terms not otherwise defined herein shall have the meanings ascribed to such terms under the Software as a Service Agreement (“SaaS Agreement“).

For the purposes of this Policy, “Personal Information” means information about an identifiable individual.

We collect Personal Information from anyone who accesses and uses the Mobile Services. By accessing or using the Mobile Services, you are agreeing to the terms of this Policy. The Privacy Policy should be read in conjunction with the SaaS Agreement. You should not use the Mobile Services unless you fully understand and agree to the SaaS Agreement and this Privacy Policy.

We take the privacy of our users of the Mobile Services (“Users“) seriously and are committed to safeguarding your Personal Information and Business Data (as defined below). NOTICE – Information We Collect and Store


We will collect information from you when you access or use the Mobile Services, including when you register for an account with us through the Mobile Services. We also collect Business Data (as hereinafter defined) and Personal Information through our website, including our contact information sign up, and well as through our marketing-related efforts.

Registration and Account Information


The information in this Section applies to all User accounts (each an “Account“). When you create an Account with Brickeye we will collect certain information from you, including your name, and your contact information, such as your email address and phone number.

Business Data


We collect certain business and other technical data that you provide to us in connection with our construction monitoring platform, and through related support and processional services, including business contact information and other project information (collectively, the “Business Data“).

Geolocation Information


We may use GPS technology (or other similar technology) to determine your current location in order to improve the Services. We will not share your current location with other users or partners.

Payment Information


If you make a payment through the Mobile Services, we will collect your credit card, debit card or banking information and other financial data in order to process the payment.

Third-Party Information


When you use the Mobile Services, we may collect information of third-parties that you provide to us or authorize us to collect, including, without limitation, the Personal Information of non-Users inviting them to join a business project (” Third-Party Data“). You are responsible for obtaining the necessary consent for the collection and use of Third-Party Data and for the disclosure of this data to us.

If you use third-party software integrated into our service (for example, Google Drive, Box, Dropbox or other programs), your information will be handled by such third party subject to their own privacy and security policies or procedures, which we do not control.

Log and Website Information


When you access and use the Mobile Services, we may automatically collect certain technical information about your visit, including the date, time, browser type, your internet service provider, your IP address, device information, including device identifiers, geo-location information, computer and network performance data, the URL that you are coming from and your navigation history in order to customize and personalize your experience on the Mobile Services, improve our Mobile Services and for statistical research purposes.

CHOICE – Use and Disclosure of Your Information


We will use your Personal Information to provide, maintain, and improve our Mobile Services and learn about our Users using the information you choose to provide to us.

Identification and Verification
We will use your Personal Information to verify your identity and the information that you provide to us.

Account Administration


We may use your Personal Information to communicate with you about our Mobile Services or the Services and your Account and to provide you with technical support.

Business Data


Brickeye uses and discloses Business Data in order to (i) fulfill your requests, (ii) send you information about our products and services, (iii) respond to your questions or concerns, (iv) analyze and improve the Services, (v) comply with applicable laws and protect rights, safety and property, (vi) and other purposes as specifically requested by the Users.

Third-Party Service Providers


We may transfer your Personal Information to a third-party service provider for processing and storage. Whenever we engage a third-party service provider, we ensure that the information is properly safeguarded at all times at a comparable level of protection the Personal Information would have received if it had not been transferred.

We may transfer your Personal Information to a third-party service provider outside of Canada. In the event that your Personal Information is transferred outside of Canada, the government, courts or law enforcement or regulatory agencies of that jurisdiction may be able to obtain disclosure of your Personal Information through the laws of that jurisdiction.

 

Legal Issues


We may use your Personal Information to detect, investigate, address and prevent fraudulent or illegal activities or to comply with applicable laws. We reserve the right to disclose your Personal Information or Business Data as required by law, when we believe that disclosure is necessary to comply with a judicial proceeding, court order, or legal process served on us and to defend against legal claims. We may also disclose your Personal Information to investigate the breach of an agreement or the Software as a Services Agreement.

The Brickeye LumiCon application’s (the “Application”) maturity and strength calculations (the “Calculations”) are based on the ASTM C1074 standard and the Application requires and relies upon the data, formula or formulae provided and/or uploaded by the User for Calculations. Brickeye shall not be held liable for any inaccuracy, miscalculation, error, mistake, imprecision, or incorrectness of any of the Application’s Calculations whatsoever arising from the Users data, formula or fomulae, and any inaccuracy, miscalculation, error, mistake, imprecision, or incorrectness of any Calculations whatsoever and any decision made by the Users thereafter in reliance on the Calculations, are made in the sole and absolute discretion of the Users and the Users, by the provision and use of, and reliance on the data, formula or formulae, assume all fault and liability arising thereunder. Brickeye shall not be held liable for any losses, damages, expenses, liabilities (whether accrued, actual, contingent, latent or otherwise), claims and demands resulting from the Users reliance upon the Application’s Calculations arising from the Users data, formula or fomulae and/or any decision made in reliance thereon.

Corporate Matters


We may disclose and share your Personal Information to explore and/or undertake a corporate transaction, including a merger, acquisition, amalgamation, IPO, reorganization or sale of Brickeye. Your Personal Information and Business Data will be used and disclosed solely for the purposes related to the transaction and will be protected by security safeguards appropriate to the sensitivity of the Personal Information.

Anonymized Information


We reserve the right to use anonymized and aggregated information and data for any purpose.

ACCESS – Retaining Your Information


If you want us to permanently delete your Personal Information or Business Data from our servers, please send an email to info@brickeye.com. We will ensure your information is deleted in a reasonable time after receiving that request. You will also be able to view and update your information through our Mobile Services in accordance with the SaaS.

We will retain any and all Personal Information or Business Data that we are required to retain under any applicable laws for the full duration of time required under those laws. We may also retain any anonymized and de-identified information and continue to use this information in accordance with this Policy.

SECURITY – Keeping Your Information Secure


Your Personal Information will be protected by security safeguards appropriate to the sensitivity of the information. We will store your Personal Information on industry standard servers that we have selected. The servers we select to store Personal Information engage security software and generally accepted standards to protect Personal Information.

There is no guarantee against data breaches. However, we have taken reasonable measures to prevent a breach. In the event of a data breach, we will notify Users of the breach at the first reasonable opportunity to do so.

Cookies


We may use “cookies” to collect information and improve the Services including the Mobile Services. A cookie is a small data file that we transfer to your computer or mobile device. We may use “persistent cookies” to save your User ID and login password for future logins to the website. We may use “session ID cookies” to enable certain features of the website, to better understand how you interact with the website and to monitor aggregate usage and web traffic routing on the website. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all aspects of our application.

We may use the data collected from “cookies” and web browsers for its own purposes, both related to and unrelated to improving our Mobile Services. In the event we disclose this data to any third-party for any purposes, it will be used anonymously and stripped of any and all personal or identifying information.

This Privacy Policy or the Service Privacy Policy (collectively, the “Policies“) may be amended or updated from time to time to reflect changes in our practices with respect to the processing of your information, or changes in the applicable law. We encourage you to read the Policies carefully.
